UAE Issues New Personal Status Law with Key Reforms

The UAE Cabinet has introduced a new Personal Status Law, bringing several significant changes. This new law addresses key issues for the first time, including setting the minimum age for marriage at 18 years.

Key Changes in the New Law:

  • Minimum Marriage Age: The law now sets the minimum age for marriage at 18 years.

  • Recovering Dowry: It provides rules for recovering dowries and gifts if an engagement is broken off.

  • Marriage Permission: Women now have the right to marry someone they choose, with the court able to intervene if a guardian unjustly refuses permission.

  • Wife’s Rights: The law ensures that wives have rights to the marital home and protects their rights in case of divorce.

  • Divorce Grounds: Either spouse can seek divorce if the other is addicted to harmful substances.

  • Child Custody: Custody laws now prioritize the child’s best interests and extend custody until 18 years old for both boys and girls.

  • Penalties: The law includes fines and imprisonment for offences like child abuse, neglect, or mismanagement of inheritance.

The law aims to improve family law by protecting rights and prioritizing the well-being of children and spouses.
